• Account - the method of storing your details with the Property Company
• AltPayNet - company that has the authority to issue KloudHouse vouchers and facilitates payments to property company.
• Customer - any person who uses the services of KloudHouse and has an agreement with the Property Company. He or she is eligible and meets all requirements set out in this Terms and Conditions and who pays for and obtains the KloudHouse voucher.
• Fees - any and all fees and charges imposed by AltPayNet Europe Limited
• KloudHouse - the web application made available to the users and customers of the Property Companies
• KloudHouse voucher - means a cash equivalent used to pay for utility bills and other services billed through a Statement of Account
• Property company - a business or organization with whom you have an Account and that has an agreement with AltPayNet to integrate the KloudHouse voucher payment scheme into its payment processing system.
• Website - the website or url branded as KloudHouse at https://kloudhouse.com
• You, Your, Yourself - refers to the person accessing the site

1. Introduction

1.1. KloudHouse is a web application owned by AltPayNet Europe Limited whose registered address is 6, Belvedere, Alfred Gerada Street Iklin, Malta (registration reference 77435).

1.2. The KloudHouse voucher is an individually encoded voucher in Euro denomination, only available within European countries used as a means to pay for its cash equivalent.

1.3. AltPayNet provides online validation of the presented KloudHouse voucher to Property Companies enabling your payment to be confirmed.

2. Acceptance of the terms and conditions

2.1. You become bound by these Terms and Conditions set out in this Agreement in relation to any use of the KloudHouse voucher and by becoming a Customer of KloudHouse.

2.2. You are not permitted to transfer or assign your rights under this Agreement to a third party.

2.3. You can redeem the KloudHouse voucher upon point of payment from AltPayNet who will facilitate the payment.

2.4. You cease to have access to these vouchers when:

2.4.1. You are no longer using KloudHouse services.

2.4.2. You won't be using credit card as a means to pay for these vouchers.

2.4.3. You were denied access to KloudHouse due to fraud or any illegal activity.

2.5. You may not use several vouchers at point of sale at any time. Failure to adhere to this would constitute a breach in this Terms and Conditions.

2.6. You must not use the KloudHouse vouchers for any illegal purpose.

2.7. You must always keep proof of payment using these vouchers including the original transaction receipt.

3. Receiving Kloudhouse voucher

3.1. KloudHouse vouchers are available in the payment cart of KloudHouse.

3.2. AltPayNet provides these vouchers to the Customers of KloudHouse who are also credit card holders as a means to pay the for the association dues, utility bills and other bills as stated in their Statement of Account.

3.3. Vouchers are readily available for consumption once the Customer clicked the Proceed to Pay button in his or her KloudHouse account.

4. Redemption

4.1. KloudHouse vouchers are automatically redeemed once the Customer submits payment to the Property Company.

4.2. One voucher can only be redeemed and used up immediately at the point of payment to the property where he or she is intended to pay. The use of multiple vouchers to pay for one payment transaction is not allowed.

4.3. Paying using a single voucher for different properties is also not allowed.

4.4. Kloudhouse vouchers don't have issued date nor expiration date as it has to be consumed once paid by credit card.

5. Making payments using KloudHouse voucher at Participating companies

5.1. You may use the Kloudhouse vouchers to make payments immediately to Property Companies.

5.2. You may only use one voucher per payment instance.

5.3. Upon payment using any credit card issued in Europe, AltPayNet will facilitate the redemption of the voucher that will be used to pay the Property Company.

5.4. AltPayNet shall submit an approval of the transaction to release a voucher to the Property Company and proceed to accept the KloudHouse voucher as payment.

5.5. AltPayNet only facilitates payment transactions and has no involvement in any contract or dealings that you have with the Propert Company. AltPayNet is not liable in any way under the terms of contract or other dealings or in any way arising therefrom.

5.6. The KloudHouse vouchers should not be used for any other purposes other than payment for the participating company.

5.7. Paying with a voucher is like paying with cash. Holders must be responsible to keep your own records of payments.

6. Security

6.1. You are solely responsible for the security and integrity of your transactions and for any posted information that you submit in the website.

6.2. You acknowledge that AltPayNet is entitled to act on any request for process payment through the Property Company's website or through KloudHouse.

6.3. AltPayNet or even the Property Company will not be liable for non-payment of your account due to your misuse of the vouchers. For any question regarding any issue on the voucher redemption, you may then contact AltPayNet at support@kloudhouse.com.

7. Refunds and Fees

7.1. When using this Service or paying using the KloudHouse vouchers, you may be subject to fees of a third party financial institution or association. You should also be aware that there may also be minimal service fees that will be charged per transaction. You are then responsible for confirming these fees prior to using the services of KloudHouse. By agreeing to these terms and conditions, you confirm that you are fully aware and that you have understood this.

7.2. AltPayNet reserves the right to refuse refund if you cannot prove that you are the Account holder or the Customer and that there are not proofs to support the transaction.

7.3. By submitting a refund application, you must understand that it will take time for validation of the account and the transaction and that you acknowledge the different validation checks and you agree to submit to such identity and security validation checks.

7.4. The amount of the refund (subject to refund fees) will be remitted to you following contact with our Support team, who confirmed that you have fully submitted the required documentations and complied with these terms and will return the amount less any applicable fees to your credit card that was used during payment of the vouchers.

7.5. We may send communication and notices to your email address that you have provided us during the refund application. Please check these communication channels for updates.

7.6. Any personal data provided in connection with a refund will be protected as specified in this agreement.

7.7 Within 30 days after the purchase, the Voucher/coupon may be refunded in full upon the request of the ? Payor/ Holder". AltPayNet through its KloudHouse Solution and in coordination with Kloudhouse's client shall immediately facilitate the reversal, refund or rebilling should there?ll be valid reason for doing so. In most cases, all these processes are automated and therefore ? Payor/ Holder? shall expect the credit to be in the payment facility such as the credit card used for the reversal, refund or rebilling transaction. In some payment methods where automation is not yet available, a separate channel such as online bank transfer, check payment or over-the-counter deposit to the appointed bank account may be executed. After the 30 day period, Kloudhouse will not refund any voucher and all sales are final, unless otherwise stated in the Fine Print.

8. Variation of Terms

8.1. AltPayNet reserves the right to vary these terms and conditions from time to time on https://kloudhouse.com for any of the following reasons:

8.1.1. Where we reasonably consider it will make the terms and conditions easier to understand

8.1.2. To reflect any changes in the cost of providing our services to you

8.1.3. To take account of regulatory requirement; or

8.1.4. Because of changes in the Applicable Law, codes of practice or the way in which we re regulated.

8.1.5. We may change our fees and charges and introduce a new fee if deemed necessary

8.2. Regulatory requirements

8.2.1. Any change on the fee or charge will be a fair proportion, as reasonably estimated and reviewed.

8.2.2. Any changes will be notified in our website and will take into effect as required by the law.

8.2.3. You are deemed to accept changes made unless, before the proposed changes are due to come into effect. Thus, you may inform us of non-acceptance of the changes so we may be able to terminate this Agreement.

9. Suspension of Service

9.1. AltPayNet gives no warranty or representation that the service will be uninterrupted or error-free or that defects in the site will be corrected.

9.2. The services of KloudHouse and any data, information, third party software, reference sites, services, or software made available in conjunction with or through the services are provided on an ?as is? and ?as available,? ?with all faults? basis and without warranties or representations of any kind either express or implied.

9.3. AltPayNet reserves the right to suspend its system when it considers necessary for maintenance or upgrade to the systems.

10. Exclusion of representation and warranties

10.1. You understand and agree that you use, access, download, or otherwise obtain information, materials, or data through the KloudHouse at your own discretion and risk and that you will be solely responsible for any damage to your property (including your computer system and device) or loss of data that results from the download or use of such material or data.

10.2. AltPayNet does not authorize anyone to make any warranty on our behalf and you should not rely on any such statement.

10.3. In no event will AltPayNet be liable for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use the website.

11. Limitation of liabilities

11.1. You acknowledge that AltPayNet is solely facilitating payments and providing its services under KloudHouse and that some limitation of liability on AltPayNet's part is reasonable and customary in an Agreement such as this.

11.2. Accordingly, you agree that AltPayNet shall not be liable for:

11.2.1. Any Property Company's failure to act upon posting of your payments.

11.2.2. Any delay or failure to carry out AltPayNet's obligations under this Agreement arising from any abnormal and unforeseeable event outside our control where the consequences would have been unavoidable despite all our efforts to the contrary.

11.2.3. All damages, liabilities, losses, and causes of action arising out of or relating to this Agreement, the Services, your use or inability to use the Services or the KloudHouse.

12. Payment for loss and third party claims

12.1. You will pay AltPayNet any amount we lose or have to pay arising from any third party claim resulting from your misuse of the voucher or any wrong payment amount, or for harm suffered directly or indirectly by AltPayNet as a result of your breach or non-observance of your obligations under this Agreement.

13. Privacy of your data

13.1. By providing us with your personal information to complete a transaction or a refund, you also give your consent allowing us to collect and use it for that specific reason only.

13.2. We may disclose your personal information if we are required by law to do so or if you violate these Terms and Conditions.

13.3. We may also store information about you using cookies. Cookies are information sent by the servers to web browsers and stored by the web browsers; in the case of mobile applications, these are stored in the mobile. The information is then sent back to the server on each requests from a browser or application. This enables AltPayNet to identify its users and activities in using the platform, web applications and mobile applications. Cookies can be disabled but it may stop our website, platform, and application from functioning properly.

13.4. We reserve the right to modify and make changes in this Privacy Policy at any time. Modifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

14. Miscellaneous

14.1. You agree that any claim or dispute you may have against must be resolved by a court located in Malta. This Agreement shall be governed by the laws of Malta, without giving effect to any principles of conflicts of law.

14.2. If any provision of this Agreement is held to be unlawful, void, invalid or otherwise unenforceable, then that provision will be limited or eliminated from this Agreement to the minimum extent required, and the remaining provisions will remain valid and enforceable.

14.3. This Agreement, and any rights granted hereunder, may not be transferred or assigned by you without our prior written consent which may be withheld in our sole discretion, but may be assigned by us without restriction. Any assignment attempted to be made in violation of this provision shall be void and of no effect.
